Mayor Michael Bloomberg of New York vs. Freedom

New Yorkers are losing freedom under Mayor Michael Bloomberg.
First Bloomberg said that people can't protest in Central Park because they might damage the grass.
Now he says that people can't go about their lives without being searched by the cops, because they might be terrorists.
New York City will begin making random checks of bags and backpacks at subway stations, commuter railways and on buses, officials announced today in the wake of a second wave of bombings on the London transit system. The checks will begin on Friday morning.
People waitng for a bus have Constitutional rights. The act of waiting for a bus doesn't mean a cop should be able to search your bags.
Similarly, the New York City subway system is a vast public place. The US Constitution ("The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures") applies there, too.
The New York Times article continues:
The announcement by Mayor Michael R. Bloomberg and Police Commissioner Raymond W. Kelly represents a significant ratcheting up of antiterrorism security in the city. Previous efforts have been limited in order to avoid causing delays in a city known for the hustle and impatience of its denizens.
Officials said the city has never before attempted to regulate the possessions of passengers in its sprawling, complex transit system. The city's subway system alone has 468 stations and carries some 4.5 million passengers on an average weekday. Some of the larger stations have at least half a dozen entrances and exits. In New York City, relatively few people own cars, and the majority of those who commute via subway carry a bag of some sort filled with items needed for the entire day, including computers, business documents, gym clothes and makeup. Many people carry two bags. It is unclear how invasive the searches will be.
"We live in a world where sadly these types of security measures are necessary," Mr. Bloomberg said. "Are they intrusive? Yes, a little bit. But we're trying to find the right balance."
Mr. Kelly said most searches will occur in subway stations, but that the Police Department "will reserve the right" to check the bags of passengers on buses and ferries as well. While the policy is still being worked out, officials said passengers will be checked before they enter a station's turnstiles, though some people inside stations may also be searched.
People who do not submit to a search will be allowed to leave, but will not be permitted into the subway station.
An ordinary man trying to get to work will probably let the cops search his bags.
A terrorist carrying a bomb will probably choose to exit the station instead of letting the cops search his bags, and explode the bomb some place else (perhaps another subway station.)
Despite the police commissioner's assurances, the new policy raised concerns about the prospect of unreasonable searches.
"The police can and should be aggressively investigating anyone they suspect is trying to bring explosives into the subway," said Christopher Dunn, associate legal director at the New York Civil Liberties Union."However, random police searches of people without any suspicion of wrongdoing are contrary to our most basic constitutional values. This is a very troubling announcement."
Whether the random searches in New York City will become an accepted part of modern life, like inspection of carry-on luggage at airports, is unclear.
This is different than searches at an airport.
Most people don't fly multiple times per day; many New Yorkers ride the subway or bus multiple times per day.
Also, the risks are different:
A small amount of explosives on a plane can kill hundreds by causing a crash; a small amount of explosives on a train is no more or less dangerous than on a sidewalk crowded with people.
If the next terrorist attack in New York is someone detonating a bomb on a crowded sidewalk, will police be allowed to search the bags of anyone walking down the street?
That would be only slight worse than what Mayor Michael Bloomberg is already putting into effect, where anyone using mass transit can be searched.
The time to draw the line is now. The New York subway system is too vast to exempt it from the Bill of Rights.
It would better advance the safety of New Yorkers for the police to investigate tips about terrorists, than to have officers who could be investigating real terrorists searching the general public.

1. This is ridiculous. I cannot believe that you are complaining about heightened security, especially in the current climate. You want a solution? You want probably cause? Who fits the profile of almost all of the terrorists of late? Search them. And yes, that may mean profiling.

| 5. A letter in today's NY Times makes the obvious point: To the Editor: You report: "Riders will be asked to open their bags for a visual check before they go through the turnstiles. Those who refuse will not be permitted to bring the package into the subway but will be able to leave the station without further questioning." But to be subject to random searches on the subway? With 4.7 million rides daily, a few random searches are unlikely to uncover any explosives. 7. As a blatant liberal and someone that frequently uses the NY subway system, I honestly had mixed feelings about this when it was announced. However, after letting the idea sink in for a bit, I do think it should not be taking place. Yes, you can refuse the search and just re-enter the subway but that is inconveniencing people just trying to go about their daily lives AND trying to maintain their civil rights. Wouldn't that fall under the category of letting the terrorists win? As in any violation of our basic rights, they should really not happen cause we'll always get into the dicussion of where you draw the line. How do we talk about fighting wars for freedom when we don't have it ourselves?

| 9. Thanks Fenton- By the way, I think that using bomb-sniffing dogs would make sense and also let the Mayor and police make a visible demonstration of vigilance. I don't believe in searching people without probable cause. The notion that if you don't want to be searched, just leave the subway, implies that the police own the subway, when the people own the subway.

10. It is the responsibility of all of us as Americans to ensure that things like this do not happen. And by "this" I mean the stripping of our rights to privacy, and against wrongful search and siezure. We, the people have to stand up and say no, we will not live like this, we will not let you take our freedoms. The argument of where we draw the line is a valid one, however, one that is easily answered. The line will be drawn where the people of this country draw it. "They" will take every inch we give them, and that is the key, stop giving them the ability America, we own this land, now start acting like it.

11. The prospect of terrorism can be scary but what scares me more than any terrorist is how quickly so many people are ready to give up their rights as United States citizens. It's been 5 days and I have yet to been asked to submit to a search upon entering the subway or bus. If I am asked I have no intention of conceding victory to terrorists' attempts at sowing fear and distrust. I've been riding the subway for 18 years and draw the line at someone asking me to open my bag while I'm going about my business just like any other New Yorker should be allowed to do.

12. Stop with the losing your freedom whining. Your understanding of the Bill of Rights and your understanding of the concept of "Freedom" is simplistic and misguided. Sure I would rather not be searched, HOWEVER, in light of current world conditions, I do not feel that Subway/Path Train searches are abridging my rights. Difficult times call for difficult measures. Deal with it.

| 13. Lou- Assume that we should sacrifice freedom in exchange for safety. How does this increase safety? Someone carrying a bomb can just say, "I don't consent to be searched" and bring the bomb elsewhere. A real measure to increase safety would be bomb-sniffing dogs.

16. Bomb sniffing dogs are by far a better solution. Bag searches, as several have pointed out, will merely cause the bomber to pick a different target. Intrusive, unconstitutional searches with no probably cause would never pass muster in any court in this country, except perhaps some of the recently appointed right wing nutjobs Bush has appointed.

17. Your talking about a city that has undergone serious terrorist attacks in the past. Your blaming bloomberg for being a tad suspicious? Terrorism is hard to prevent, Bloomberg is trying to keep his people safe. People will be allowed to carry their normal belongings, so long as its legal, undergoing a small, non invasive search shouldn't be a problem. Especially for a city that has been, and will be the target for terrorism in the future, a city with a vast, and vulnerable subway and public transit system.

| 18. I want EFFECTIVE action against terrorism in New York City. Random searches are ineffective. Better to use bomb-sniffing dogs. Better still to pursue tips to find and arrest the terrorists regardless of what type of attack they have planned.

19. WOW!! There is so much to say about this subject. You know I spent most of my life as a liberal and I believed we should do what we want when we want and no one should violate our everyday lives and tell us what we can or can not believe. It's funny cause I look back now and see how many things have changed because of our "liberal rights" and how our country has went to shit because of those views...we don't say the pledge of allegance because it has God in it and it might offend someone, we won't allow people to spank their kids cause it will hurt them psychologically and someone might take them away, people stopped asking questions about their neighbors actions cause they were called nosey. Now people are trying to sue the city because they feel their rights are being violated when they get caught up in a random bag search. Come on people are you serious? This is why people don't know what is going on in the world. Children are bringing guns to school! Terrorists are living next door to us! And everyday they walk next to you and get on the subway! Irregardless of whether they will go somewhere else or be stopped at the bag search something needs to be done! GOOD! Have them go somewhere else, have them be afraid to go to our subways and our bridges and our airplanes...tell to go somewhere else but here. Random means you don't know when it is going to happen! You might get the terroist or you might get the old lady next door. GOOD! That way no one will feel like we are "profiling" It's an antiterrism act people! It is supposed to "prevent terrorism"!! It cracks me up how quick you all forget about the 9/11. Trust me....sitting in Iraq...you don't forget WHAT you are fighting for....or WHO you are fighting it for!!!

Bomb dogs, drug dogs...they cost way too much to be just sitting on some subway...we have to put them to better use!!!
